ABOUT MAGNURS AND CONDITIONS OF SALE

 

These Conditions of Sale apply to all purchases of Magnurs products or services that you may order from our Website (as defined below).

The entity selling the products to you will be determined by the delivery address to which the products are shipped (referred to as the “Selling Entity,” “Magnurs,” “we,” “us,” or “our”):

 

  • Magnurs LLC, Shams Business Center, Sharjah Media City Free Zone, Al Messaned, Sharjah, UAE.

 

The Selling Entity owns and manages the Website under the Terms of Use, which is responsible for our data collection practices as outlined in the Privacy Policy and Cookie Policy. By placing an order, you agree to be bound by the Terms of Use, Privacy Policy, Cookie Policy, and the Returns and Exchanges Policy, all of which are incorporated into these Conditions of Sale. For more details on our return policy, please review our Returns and Exchanges Policy.

Please review these Conditions of Sale carefully, as they apply to all orders placed via the Website. Prior to placing an order, you will be required to accept these Conditions of Sale. If you do not agree, you will not be able to make purchases through the Website.

 

PURCHASING ELIGIBILITY

 

Only individuals (not legal entities) who meet the following criteria may place orders through the Website: (a) have reached the legal age of majority required to enter into contracts (21 years in the United Arab Emirates); (b) have the legal capacity to enter into contracts; and (c) provide a shipping address within the country or countries we ship to, as specified by the Sales Channels. If you are under the legal age of majority (21 years) or otherwise unable to lawfully enter into a contract, your parent or guardian must place the order on your behalf, and they will be required to accept these Conditions of Sale.

 

By placing an order through the Website, you confirm and warrant that you are a genuine end-user customer purchasing for personal use (either for yourself or as a gift) and that you will not deliver, sell, or otherwise distribute our products, nor are you purchasing them for commercial purposes.

 

In order to make purchases on the Website you will be required to provide your personal details and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent, and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.

 

PRODUCT AVAILABILITY AND QUANTITY

 

All orders placed through the Website are subject to product availability and our acceptance. Products displayed on the Website that cannot be added to the shopping bag are not available for purchase via the Website. For further details on these products, please contact the Customer Care. For information about the ordering process, please see our Order Process section below.

Quantity restrictions may apply to certain products. We reserve the right to decline orders at any time without prior notice if they exceed the permitted quantity.

The quantity limits include, but are not limited to:

One piece per reference per customer every 90 days for Limited Editions and Middle East Exclusives.

No more than two pieces of the same reference for accessories other than Limited Editions and Middle East Exclusives per invoice.

No more than five pieces of the same item purchased per month online.

The total number of accessories per invoice cannot exceed five.

The total number of accessories purchased per month cannot exceed fifteen.

 

 

ACCOUNT REGISTRATION AND GUEST CHECKOUT

 

 

To place an order, you have the option to either register and create an online account or proceed as a guest by selecting the “Guest Checkout” option. If you choose to order as a guest, we may still create an account in our internal systems to record your purchase(s).

 

 

ORDER PROCESS

 

The order process on the Website involves the following steps:

 

Add to Shopping Bag: After selecting a product, you can add it to your shopping bag. You may continue shopping and add additional items, subject to availability and quantity limits. Adding an item to your shopping bag does not guarantee its availability for purchase, which is only confirmed upon receipt of a written Confirmation of Order & Shipment.

 

Guest/My Account Checkout: When ready, proceed to “Checkout,” choosing either to check out as a guest or through your registered account. You may also remove items from your shopping bag during this process.

 

Delivery, Review, and Payment: During checkout, review your order details and personal information (including email, shipping address, billing address, and payment information). Ensure all details on the order summary page are correct before placing your order.

 

Placing the Order: Check the relevant box to confirm and place your order.

 

We offer products for sale that are in stock and available for dispatch. Occasionally however, we may be waiting for shipments from our suppliers. Please be aware that we may be unable to deliver selected products due to production problems or quality check issues identified when we receive a product from our supplier. In these circumstances we will notify you by email and refund any payment made by you within thirty days of being advised that products become unavailable.

 

Sometimes, high demand causes us to run out of certain products. If we don't have a product that you have ordered in stock, we'll notify you by email immediately.

 

Orders may be placed for personal use only, any commercial use excluded.

 

We have the right to cancel any order placed by you in the event you have been involved in a dispute concerning a prior order, or if We have reasonable ground to suspect that you have violated these terms and Conditions of Sale, or are or appear to be engaged in fraudulent activities or use of purchased products other than for personal use as permitted by these Conditions of Sale. We have the right to refuse any order at our discretion.

 

We reserve the right, at our sole discretion, to refuse, cancel, or terminate orders at any time for reasonable grounds. This may include disputes over payment for previous orders or suspicions of either fraudulent activities or violations of these Conditions of Sale.

 

PRICES, TAXES AND SHIPPING COSTS

 

All prices displayed on the product pages of the Website include 5% VAT, shipping costs and other taxes unless stated otherwise. The prices displayed for our products on the website are in USD. You shall choose to pay using the relevant online payment link provided by Astra Verde DMCC. These prices are subject to change at any time in our sole discretion.

 

Before finalizing your payment, please review all details carefully. By completing the payment, you confirm your purchase, and we will proceed with preparing your order for delivery.

 

The currency applicable to your order will be updated based on the shipping destination once you provide your delivery address and will be displayed in your shopping bag before you complete your order. Please verify the updated prices and currency carefully.

 

Sales, use, or other taxes may vary depending on the shipping location.

 

Shipping costs, if applicable, are detailed in the Shipping Policy below or on the Website. These costs are not listed on the product pages but will be added to the product price based on your selected delivery options. Shipping costs will be summarized before you confirm and place your order and will also be reflected in our email correspondence after you choose your delivery options.

 

We reserve the right to adjust prices and delivery costs at any time without prior notice.

 

While we make every effort to ensure that prices and delivery costs are accurate at the time they are entered into the system or communicated to you, errors may occur. If there is a pricing or delivery cost error for any of the products you order, we will notify you as soon as possible. If we cannot reach you using the contact details provided during the order process, we will cancel the order and inform you in writing. In cases where we mistakenly process your order despite a pricing or delivery cost error, we may cancel the supply of the product and refund any payments made.

 

Please note that changes in applicable law between the date of your order and the date you receive a written Confirmation of Order & Shipment may affect the taxes associated with your order. If this results in an increase in taxes, we will contact you to request confirmation of your order.

 

PAYMENT

 

The payment for the selected products shall be made exclusively through the payment link provided by Astra Verde DMCC, located in Dubai, United Arab Emirates.

 

By using the payment link, you acknowledge that the transaction will be processed in United States Dollars (USD) and that full payment must be completed prior to the dispatch of any products.

 

Upon successful completion of the payment, you will receive a confirmation via email, which shall serve as proof of payment.

 

Astra Verde DMCC and Magnurs reserve the right to cancel the order and withhold delivery if payment is not received or confirmed.

 

 

We accept the payment methods specified during the order process through the Website. Depending on the chosen payment method, additional information or forms of identification may be required.

 

 

For orders placed on the Website, you will need to enter your payment details on the provided form. For telephone orders, you will need to provide your complete payment details to the Client Relations Center or follow the instructions given by the Center.

 

All payment card transactions are subject to validation checks and authorization by the card issuer. If your card issuer declines the payment, you should contact them directly to resolve the issue.

 

Other payment methods may also be subject to validation checks and authorization by payment system providers. You authorize us to conduct necessary security checks, including obtaining information from third parties, to verify your identity, validate your payment card, and authorize transactions.

 

When using a credit card, debit card, or ApplePay, the full amount of your purchase may be charged immediately upon order placement. This pre-payment does not affect your legal rights under these Conditions of Sale, including your right to a refund. If we are unable to fulfill our shipping and delivery obligations, we will notify you by email and promptly refund your pre-payment.

 

We take reasonable care to make our Website secure. All credit/debit card transactions on the Website are processed using a third-party platform, Stripe, a secure online payment gateway that encrypts your card details in a secure host environment. To help ensure that your shopping experience is safe, simple, and secure, our Website uses Secure Socket Layer (SSL) technology.

 

We may, at our discretion, accept bank wire transfers for orders. While we do not charge a fee for bank wire transfers made through the Sales Channels or Client Relations Center, some financial institutions may impose fees. For telephone orders paid by bank wire transfer, an order approval process is required. Your order will only be processed after we have confirmed receipt of the payment via email. If the wire transfer is not credited to our account within seven (7) days of placing your order, the order will be canceled. If the issuer of your credit/debit card refuses to authorize payment, we will not be liable for any delay or non-delivery.

 

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide us when accessing or ordering from the Website.

 

Any disputes regarding payment must be reported to Astra Verde DMCC within 14 days of the transaction date.

 

ACKNOWLEDGEMENT OF ORDER

 

After placing your order through the Website, you will receive a written Acknowledgement of Order (via email or other means) confirming the details of your order along with an order reference number. Please keep this reference number for any future inquiries about your order.

 

Note that this Acknowledgement of Order does not signify acceptance of your order. We will perform standard credit, anti-fraud, security, and legal checks before processing your order. Once we have confirmed these checks and accepted your order, we will proceed with processing it.

 

Upon receiving the Acknowledgement of Order, it is your responsibility to review it and ensure that it accurately reflects your intended order. If you have any questions, concerns, or if the Acknowledgement does not match your intentions, please contact the Customer Care immediately.

 

Acknowledgement of the order and completion of the contract between you and Magnurs will be perfected when we dispatch the products to you at which time you will receive a second email containing you tracking number and confirming that your order has been dispatched. The sale contract is therefore concluded in the United Arab Emirates. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of Magnurs.

 

These Conditions of Sale will be provided to you with the Acknowledgement of Order.

 

We reserve the right not to accept or fulfil your order in the event, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular product, that the product ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set-out within these Terms.

 

Furthermore, we may refuse to process your order for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party in this respect.

 

Though we make every effort to make sure details on our Website are accurate, we may from time to time discover an error in the pricing of products.

 

If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit.

 

If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the products, we shall refund the full amount as soon as we are able.

 

 If products are recalled in transit, we will process your refund once the products have been returned to us.

 

SHIPPING POLICY

 

We only accept orders for delivery to the countries specified during the Order Process. Please be aware that we do not ship to certain addresses, including military locations, restricted areas, pick-up points, or PO boxes. For more details, refer to our FAQs section or contact the Customer Care.

 

If you order multiple products, we will only ship your order once all items are available. Partial shipments will not occur unless communicated otherwise.

 

CONFIRMATION OF ORDER AND SHIPMENT

 

Once your order has been shipped, we will send you a Confirmation of Order & Shipment (via email or other means). This confirmation signifies our acceptance of your order and establishes a binding sales contract.

 

DELIVERY

 

Standard delivery is complimentary for all orders. Please allow 15 working days for Standard Delivery. We will make reasonable efforts to ensure that your order is delivered by the carrier within the estimated delivery time specified in our Confirmation of Order & Shipment, and in any case, within thirty (30) days from that date. This timeframe may be extended if your order involves products or services that require additional time, such as personalized or custom-made items.

 

If a delay occurs due to factors beyond our control, we will notify you as soon as possible and work to minimize the impact of the delay. If we do not deliver within the thirty (30) days from the Confirmation of Order & Shipment or any other specified timeframe, you may contact the Customer Care. to cancel the order and receive a refund for any products you have not received.

 

Your only remedy for any failure to deliver will be the right to cancel the order and receive a refund for any undelivered products. Please consider that delivery times may be affected by credit approval, address verification, security checks, and order processing. Delivery is contingent upon full payment.

 

Upon delivery, you or a designated person at the delivery address must provide a handwritten or electronic signature to confirm receipt. Risk and responsibility for the goods transfer to you upon this confirmation. If you have designated someone else as the recipient (e.g., for a gift), their signature will serve as proof of delivery and fulfillment of the sales agreement by Magnurs. We reserve the right to deliver only to the intended recipient as indicated on the parcel label and may require ID verification for certain products. Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be represented at a larger than actual size to clearly show details, or smaller than actual size in order to show the entire item. If your received item does not match the size you selected, you are welcome to utilize our return or exchange policy as outlined in this Policy.

 

INVOICES

 

When you place an order through the Website, you will receive an invoice in writing, sent to your email address as a PDF attachment or by another method.

 

 

FORCE MAJEURE

 

We are not responsible for any delay in, or failure of, performance of our obligations under any these Conditions of Sale arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, epidemic, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.

Please note that nothing contained in these Conditions of Sale in any way affects your statutory rights.

MANUFACTURER'S GUARANTEE AND YOUR LEGAL CONSUMER RIGHTS

 

We are dedicated to ensuring that every product meets our stringent quality standards and has undergone comprehensive technical and aesthetic checks. All our products are covered by the Magnurs Guarantee. If you need to repair a product covered by this guarantee, please contact our Customer Care for further assistance.

As a consumer, you may have legal rights under the relevant laws governing the sale of consumer goods. These legal rights are not diminished by these Conditions of Sale or the Magnurs Guarantee.

 

 

COMPLIMENTARY SERVICES

 

The following complimentary services are offered by Magnurs at no additional charge:

(a) Gift Wrap and Packaging
All orders will be shipped in a Magnurs box, and accompanied by a Magnurs shopping bag (if applicable).

(b) Gift Note
You can add a personalised note to your order, which will be printed on a gift card and included in your package. Magnurs reserves the right to reject any gift card notes deemed offensive or inappropriate for inclusion on Magnurs-logo stationery.

 

REPAIRS

 

For any repair inquiries regarding a product purchased through the Website, please consult our FAQs section or reach out to our Customer Care.

 

 

LIMITATION OF LIABILITY

 

To the fullest extent allowed by applicable law, we disclaim and exclude all other terms, conditions, and warranties related to the products, whether express or implied by statute, or arising from prior dealings, customs, or trade practices.

 

Nothing in these Conditions of Sale limits or excludes our liability for any matters that cannot be limited or excluded under applicable law. Subject to this, our total liability to you under these Conditions of Sale, whether in contract, tort (including negligence), or otherwise, will not exceed one hundred percent (100%) of the price of the product(s) in your order, even if we have been informed of the possibility of such damages.

 

Please note that in some jurisdictions, consumer protection laws may restrict or prohibit certain exclusions or limitations of warranties or liabilities, meaning some of the above exclusions and limitations may not apply to you.
